Terms of Service

Odin AI offers AI tools and services; their terms of service outline user obligations, acceptable use, intellectual property rights, and liability limits.

1. Agreement to terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity, and One Realm Inc. (Company, One Realm, we, us, Odin, or our), concerning your access to and use of the getodin.ai website and any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto. By accessing the Site, you agree that you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree with all of these Terms of Service, you are expressly prohibited from using the Site and must discontinue use immediately. Supplemental terms and conditions or documents posted on the Site are incorporated by reference. We may make changes to these Terms from time to time by updating the Last updated date. The Site is intended for users who are at least 18 years old.

2. Intellectual property rights

All information and materials on the Site and/or Service, excluding Third Party Content, are owned or controlled by us or licensed to us and protected by copyright, intellectual property, unfair competition, and related laws. The Content is provided AS IS for your information and personal use only. Except as expressly provided in these Terms, no part of the Site, Service, or Content may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for a commercial purpose without our prior written permission. Third Party Content remains the copyrighted work of its owner. All trademarks, service marks, and logos are the property of Odin or third parties.

3. User representations

By using the Site, you represent and warrant that all registration information you submit will be true, accurate, current, and complete; you will maintain the accuracy of that information; you have legal capacity and agree to comply with these Terms; you are not a minor in your jurisdiction; you will not access the Site through automated or non-human means; you will not use the Site for any illegal or unauthorized purpose; your use of the Site will not violate applicable law; and you are not barred from receiving services under U.S. law or other applicable jurisdictions. If information you provide is untrue, inaccurate, not current, or incomplete, we may suspend or terminate your account and refuse current or future use of the Site.

4. Export control

You represent and warrant that you understand some Content or Service components may be subject to export, re-export, and import restrictions under applicable law; you will not use the Site, Content, or Service in a manner that violates U.S. export regulations; and you are not located in, under the control of, or a national or resident of any country to which the United States has embargoed goods.

5. User registration

To access and use all features of the Service, you may be required to open an account. You agree to keep your password confidential and are responsible for all use of your account and password. We may remove, reclaim, or change a username if we determine it is inappropriate, obscene, or otherwise objectionable. You may be invited to establish or join an Odin Pro or Enterprise Team Account, where an administrator may accept or remove members and certain account data, usage, and User Content may be viewable by Team Account members.

6. Fees and payment

We accept Visa, Mastercard, American Express, Discover, and PayPal. To access the Site and/or Service, or parts of them, you may be required to purchase or pay applicable fees. You agree to provide current, complete, and accurate purchase and account information and to promptly update account and payment information. We bill through an online billing account or invoices emailed to your billing contact. Sales tax may be added as required. We may change prices at any time, all payments are in U.S. dollars, and recurring charges may apply until cancellation.

7. Cancellation and termination

All purchases are non-refundable. You can cancel your subscription at any time by contacting us using the contact information provided below, with cancellation effective at the end of the current paid term. Odin may terminate your account and/or these Terms at any time and for any reason upon notice, and may suspend Service at any time with or without cause. Once your account is terminated, we may permanently delete your account and any or all User Content associated with it.

8. Paid service

If you pay fees to use or access the Site or Service, the Company will use commercially reasonable efforts to provide the Service. Each party may receive business, technical, or financial information from the other party and agrees to protect such Proprietary Information and not use or disclose it except as permitted. Subscriptions renew automatically for additional periods of the same duration unless either you or Odin requests termination at least thirty days before the end of the then-current term.

9. Prohibited activities

You may use your User Account for the Service and/or Site only in accordance with these Terms and lawful purposes. You may not access or use the Site for any purpose other than that for which we make it available, and the Site may not be used for commercial endeavors except those specifically endorsed or approved by us.

  • Systematically retrieve data or content to create or compile a collection, compilation, database, or directory without written permission.
  • Trick, defraud, or mislead us or other users, especially to learn sensitive account information.
  • Circumvent, disable, or interfere with security-related features of the Site.
  • Upload or transmit viruses, Trojan horses, spam, or other material that interferes with Site operation or use.
  • Use automated systems, data mining, robots, scrapers, or similar data gathering tools except through standard search engine or browser usage.
  • Impersonate another user or person, collect usernames or email addresses for unsolicited email, or create accounts by automated means or false pretenses.
  • Copy, adapt, decipher, decompile, disassemble, or reverse engineer Site software except as permitted by law.
  • Use the Site as part of an effort to compete with us or for unauthorized revenue-generating endeavors.

10. Linked accounts and services

The Site and/or Service may contain links to and integrations with third-party websites and services, such as Gmail. Odin provides these links and integrations solely as a convenience and is not responsible for the content or availability of those websites or services. Access to any linked site is at your own risk and is subject to the terms applicable to that website or service.

11. User generated contributions

The Site does not offer users the ability to submit or post content, but we may provide opportunities to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials. Contributions may be viewable by other users and through third-party websites. When you make Contributions available, you represent that you have the necessary rights and permissions, that your Contributions are not false, misleading, unlawful, offensive, infringing, harassing, or otherwise in violation of these Terms.

12. Contribution license

We may access, store, process, and use information and personal data you provide according to the Privacy Policy and your choices. By submitting suggestions or feedback about the Site, you agree we can use and share that feedback for any purpose without compensation. We do not assert ownership over your Contributions, and you remain solely responsible for them.

13. Submissions

Any questions, comments, suggestions, ideas, feedback, or other information regarding the Site that you provide to us are non-confidential and become our sole property. We may use and disseminate these Submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.

14. U.S. government rights

Our services are commercial items as defined in FAR 2.101. If acquired by or on behalf of U.S. government agencies, our services are subject to these Terms in accordance with applicable FAR and DFARS provisions. This clause supersedes any other clause addressing government rights in computer software or technical data under these Terms.

15. Site management

We reserve the right, but not the obligation, to monitor the Site for violations of these Terms, take appropriate legal action, refuse or restrict access to Contributions, remove excessive or burdensome files and content, and otherwise manage the Site to protect our rights and property and facilitate proper operation of the Site and Service.

16. Privacy policy

We care about data privacy and security. Please review our Privacy Policy. By using the Site, you agree to be bound by the Privacy Policy, which is incorporated into these Terms. The Site is hosted in the United States, and by continuing to use the Site from other regions, you agree to transfer and processing of your data in the United States.

18. Term and termination

These Terms remain in full force while you use the Site. We reserve the right, in our sole discretion and without notice or liability, to deny access to and use of the Site to any person for any reason, including breach of these Terms or applicable law. We may terminate your use of the Site or delete your account and content at any time. If terminated or suspended, you may not register a new account under your name, a fake or borrowed name, or a third-party name.

19. Modifications and interruptions

We may change, modify, remove, suspend, or discontinue all or part of the Site at any time without notice. We cannot guarantee the Site will always be available and may experience interruptions, delays, errors, or maintenance downtime. We are not liable for any loss, damage, or inconvenience caused by inability to access or use the Site during downtime or discontinuance.

20. Governing law

These Terms of Service and your use of the Site are governed by and construed in accordance with the laws of the State of Delaware applicable to agreements made and performed within Delaware, without regard to conflict of law principles.

21. Dispute resolution

To expedite resolution and control costs, the parties agree to first attempt to negotiate disputes informally for at least thirty days before initiating arbitration. Legal actions shall be commenced or prosecuted in state and federal courts located in Delaware, and the parties consent to venue and jurisdiction in those courts. Claims related to the Site must be commenced within one year after the cause of action arose.

22. Corrections

The Site may contain typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and other information. We reserve the right to correct errors, inaccuracies, or omissions and to change or update information on the Site at any time without prior notice.

23. Disclaimer

The Site is provided on an as-is and as-available basis. Your use of the Site and our services is at your sole risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant or assume responsibility for the accuracy or completeness of Site content or linked website content, interruptions, errors, unauthorized access, bugs, viruses, or third-party products or services advertised or offered through the Site.

24. Limitations of liability

The Site, Content, and Service are provided strictly on an as-is and as-available basis. One Realm Inc. disclaims implied, statutory, and other warranties regarding the Site, Content, Service, and availability. To the fullest extent permitted by law, One Realm Inc. will not be liable for indirect, incidental, consequential, punitive, special, exemplary, or statutory damages, including loss of business, profits, revenue, data, goodwill, cost of cover, or substitute goods or services, even if advised of the possibility of such damages. Aggregate liability will not exceed fees paid by you in the six months preceding the claim.

25. Indemnification

You agree to defend, indemnify, and hold us harmless, including subsidiaries, affiliates, officers, agents, partners, and employees, from losses, damages, liabilities, claims, demands, attorneys' fees, and expenses arising from your Contributions, use of the Site, breach of these Terms, breach of representations and warranties, violation of third-party rights, or harmful acts toward other users. Odin takes no responsibility for loss, damage, liability, claim, or demand made by a third party or arising out of Odin-generated content. User discretion is advised regarding factual correctness, plagiarism, language, and opinions expressed by Odin in response to user input.

26. User data

We maintain certain data you transmit to the Site to manage Site performance and data relating to your use of the Site. You are solely responsible for all data you transmit or activities you undertake using the Site. You retain ownership of User Content transmitted through the Service and are responsible for its accuracy, quality, legality, acquisition, and transmission. You grant Odin a royalty-free, worldwide, transferable, sublicensable, irrevocable, perpetual license to use feedback related to the Site or Service. Odin may collect, analyze, aggregate, and anonymize data relating to Service use and performance to improve Odin offerings and disclose de-identified data in connection with its business.

27. Electronic communications, transactions, and signatures

Visiting the Site, sending emails, and completing online forms constitute electronic communications. You consent to receive electronic communications and agree that agreements, notices, disclosures, and other communications provided electronically satisfy legal requirements that communications be in writing. You agree to electronic signatures, contracts, orders, records, and electronic delivery of notices, policies, and transaction records.

28. Notices

Odin may provide general notices through the Service portal and specific notices by email to your account email address or by written communication to your address on record. If you have a dispute with Odin, wish to provide notice under these Terms, or become subject to insolvency or similar proceedings, you must promptly send written notice to One Realm Inc., 4011, Adriatic St., Oxnard, CA 93035, Attn: Legal.

29. California users and residents

If a complaint with us is not satisfactorily resolved, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210 or (916) 445-1254.

30. Miscellaneous

These Terms of Service and any policies or operating rules posted by us constitute the entire agreement between you and us. Failure to exercise or enforce any right is not a waiver. We may assign our rights and obligations, and we are not responsible for loss, damage, delay, or failure to act caused by causes beyond our reasonable control. If a provision is unlawful, void, or unenforceable, it is severable and does not affect remaining provisions. No joint venture, partnership, employment, or agency relationship is created by these Terms or use of the Site.
